Rules and Regulations

  2. Contest Period

    Several "ExamBank Noggin Hoggin' Challenges" (hereinafter called "Challenges") will be held, with start dates as specified on the Internet at http://www.exambank.com/challenge/schedule.html. Each challenge will begin on the specified start date at 12:00 am Pacific Time, and conclude 6 days later at 11:59:59 pm Pacific Time.

  3. Eligibility

    A challenge is open to all legal residents of Canada registered as students from Kindergarten to Grade 12 in a Canadian school, with the exception of residents of Québec or where participation in these challenges is prohibited by law. All winning participants will require parental and/or legal guardian consent to claim prizes. Employees of Syzygy Research & Technology (hereinafter called "SR&T), their immediate family members, or any of a specific challenge's sponsors are not eligible to participate. There is a limit of one entry per person during each challenge period. Any discovery of multiple entries for a single individual may result in the cancellation of all entries for that individual. Though an individual may enter and participate in multiple challenges, he or she is only eligible to win one of a challenge's three top prizes once per calendar year.

  4. Game Details

    Upon commencement of a challenge, participants will have 24 hours to access the project website (http://www.exambank.com/challenge/) to view a question and submit their response. Participants may submit as many responses during that time period as they wish, however only the last one is considered. At the end of the 24 hour period, those participants who answered correctly can continue on to the next question which is revealed at that time. Those who did not answer correctly will also have the opportunity to continue on to the next question, however a 10 minute penalty towards the final, time sensitive question on day 6 will be incurred. This process will continue until 5 questions have been asked over the course of 5 days. Should a participant answer more than one of the first 5 questions incorrectly, the 10 minute penalties will accrue, and the resulting total will be applied to the last question of the challenge. In addition, a special "hidden" bonus-style question may be made available for any given challenge. Discovering the existence and method to obtain this question will be revealed through clues in various promotions relating to the challenge. If this special question is discovered and correctly answered prior to the commencement of a challenge, the participant will be provided with a special and unique code that can be used as a valid correct response for any of the 5 initial questions. The code can only be used once in the challenge, however, so the participant must decide for themselves when it is in their best interest to use it. The last challenge question, provided on the 6th day of the challenge, will be time-sensitive. Released at 11:00 am Pacific Time, participants will be ranked by the time sequential order in which they successfully answer the question, and all penalties are automatically applied at this time. Again, a participant may submit more than one response if they wish, but only the last answer and the time it was submitted will be considered in establishing an individual's ranking. Participants must answer the final question correctly to successfully complete the challenge and be eligible for prizes. The challenge will be considered to have concluded at 11:59:59 pm Pacific Time on this last day, at which point every successful participant's ranking will be finalized. Participants who are eligible for a prize based on this ranking will then be contacted by email with a prize claim form.

  5. Prizes

    Specific prizes vary by the particular challenge, and will be listed at http://www.exambank.com/challenge/ prior to the start date of a challenge. Prizes must be accepted as awarded, with no substitutions or exchanges, except by a prize's sponsor (if applicable), who reserves the right to substitute a prize with one of comparable or greater value, at its sole discretion. Should a winner be unable or unwilling to claim their prize, his or her prize will be forfeited. Approximately 50 prizes are available to be won for each challenge, with a total minimum retail value of $1,000. The chances of winning depend on the total number of participants for a given challenge, and a participant's performance throughout the course of the challenge. SR&T reserves the exclusive right to determine an individual's eligibility for prizes. All decisions are final. In order to claim a prize and confirm a student's registration at a Canadian school, a winning participant will be required to send a prize claim form containing the signatures of an administrator from their school and that of a parent and/or guardian to SR&T, either by fax or postal mail. Prize claim forms will be sent by email to winning participants and must be completed and received by SR&T within 14 days, or their prize will be forfeited. Incomplete prize claim form submissions will not be processed and will be void. SR&T is not responsible for late, lost, stolen, misdirected, delayed, inaccurate, incorrect, inaudible, garbled, dog-eaten, locust-shredded, or undelivered prize claim forms. If any prize notification email or prize is returned as undeliverable, or SR&T is unable to contact a potential winner within a reasonable time period, the potential winner will be disqualified, their prize will be forfeited, and, at SR&T's sole discretion, the prize may be awarded to another contestant. Prizes will be fulfilled within 6 weeks of the date of receipt of a qualifying prize claim form, and will be sent to the winner in care of their school. Prizes are awarded "as is" with no warranty or guarantee, either express or implied by SR&T. A list of the winners' grades, genders, schools, towns, and provinces may be made available at http://www.exambank.com/challenge/winners/

  6. Enrollment

    Each challenge is conducted exclusively on the Internet, and as such, registration and participation in a challenge requires a participant to provide their own Internet connectivity. A participant also agrees that communication before, during, and after a challenge will be done exclusively through email and interaction with the project website (http://www.exambank.com/challenge/). All participants must enroll for an upcoming challenge at the project website, and agree to abide by these challenge rules and regulations, which are final. Personal details provided to SR&T as part of the registration process will not be made available to third parties without the consent of the parent or guardian of the participant, with the exception of the participant's town or city, province, gender, grade level, and school.

  7. Limitation of Liability

    By enrolling or participating in any of the challenges, the entrant voluntarily assumes all risks in connection with any prizes and their use, and waives any and all claims they may have arising in connection with a challenge. They also release SR&T from all liability, including without limitation, any financial, legal, or moral responsibility or loss or personal injury including death or damage to or loss of property suffered or incurred or arising from the acceptance of any prize as awarded, whether suffered by the participant, winner, or his or her heirs, administrators, personal representatives, or executors, and notwithstanding that such injuries or losses may have been caused solely or partly by any act, omission, or negligence of SR&T. SR&T also assumes no responsibility or liability due to any failure or technical malfunction of the project web site, Internet access providers, Internet congestion, telephone network, computer equipment, software, failure of any email, or any other reason of cause made during a challenge. Further, SR&T will not be liable for any injury or damage to any person's computer or other equipment relating to or resulting from participating or downloading any material in a challenge.

  8. Email Consent

    As participation in the challenges necessitates the ability for us to contact you by email, by enrolling in a challenge you give your explicit consent authorizing SR&T to contact you by email for any reason relevant to Noggin Hoggin' Challenges. This consent may be withdrawn at a future time, either by clicking an "unsubscribe" link in the email or by contacting us directly, but if such consent is withdrawn, your ability to participate in any challenges will also be withdrawn, even if a challenge is currently underway.

  9. Modifying the Terms of a Challenge

    If, for any reason, any portion of a challenge is not able to run as planned or if the administration, security, fairness, integrity, or proper conduct of a challenge is adversely affected, including without limitation by reason of infection by computer virus, software bugs, tampering, unauthorized intervention, fraud, technical failures, question accuracy, or any other cause beyond its control, SR&T reserves the right to cancel, terminate, or modify challenge rules without individual notice.
